On the minimum space
requirements list, can any of
the functions be combined
or must they all be entirely
separated?

Yes, it is possible to combine but the architect has to present logical reasoning for that for the acceptance of the Selection Committee.

Would it not make sense to
have all the public functions
on the ground floor, and if
so would there not be a
preference, especially from
a security standpoint to
have the consular function
immediately adjacent to the
street entrance?

Since Culture Centre facilities are also public in nature and as such a separate wing, it is advised not to take any the culture centre facilities to the first floor. However, if space permits, Public dealing of the Consular Section may definitely be accommodated at Ground floor.

ln the event there are
conditions of the RFP that
are uninsurable, and as
such not acceptable to us,
would it be possible to
complete the RFP with an
appropriate exclusion
qualification ? For example,
we could accept all the
terms and conditions except
item 7.0 liquidated
damages, would that cause
our being disqualified?
Although I am familiar with the UK practice of Defects Liability it is not common practice in the USA.

Acceptance of Terms and conditions by
the participant Architect is compulsory in nature. However, if any of the conditions of the RFP are not in consonance with any local regulations / laws, the same can be placed before the selection committee whose decision would be final in this case and the architect would have to accept the same.

Item 5.0 requires our
carrying out additional work,
but without reference to
compensation, we would
propose to add a clarification to our proposal that provides for requested additional services being
paid, would that be acceptable?

Since the responsibility of the architect consultant is till the completion of the work, any deviation / revision shall not be paid separately. The Architect may define and include the scope of additional services, if anticipated by any individual at this stage only. No additional fee/ payments shall be entertained at any later stage.

We would need confirmation that this work was a matter of right and as such does not include
zoning waivers, Code modification or any involvement with local ANC
groups, and that a facade as approved by Historic review would be acceptable.

Preparing and submission of Design concept which are as per prevailing local
body regulations is the responsibility of the architects and preparing all documentations and facilitating the Mission for obtaining Local body approval shall be the responsibility of the selected architect.
However, this being a part of diplomatic functional needs, if required, Mission would approach the local authorities for any waivers if permitted with the regulations.

6.

We would also want to have
the final contract for the work be a standard AIA Form between Architect and Owner, in the event we were successful.

This RFP is based on the Ministry's
already approved format, hence it would not be possible to concede to this request.

However if any new clause is required to be inserted that can be considered provided it does not dilute any of the provisions of the RFP. The architectural firms may place the same before the Selection Committee.
